Terms of Use
1. Acceptance of Terms
Welcome to NestMind. These Terms of Use ("Terms") constitute a legally binding agreement between you and NestMind App ("we," "us," or "our"), an individual developer, governing your access to and use of the NestMind iOS application ("the App").
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not install or use the App.
You must be at least 13 years of age to create an account. Users between the ages of 13 and 17 may use the App only with the involvement and consent of a parent or legal guardian, who accepts these Terms on their behalf.
2. Description of Service
NestMind is a family coordination application available exclusively on iOS. The App allows households to create and manage shared task lists, recurring routines, and calendar events, assign responsibilities to family members, and communicate through in-app notifications about task status.
The App is provided through Apple's App Store and requires an iOS device running iOS 16 or later. Core functionality depends on an active internet connection for real-time synchronization across devices. The App uses Firebase (a Google product) for authentication, data storage, and push notifications.
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice. We will make reasonable efforts to notify users in advance of significant changes.
3. Account Registration
To use NestMind, you must create an account using either an email address and password or Sign in with Apple. You agree to:
- Provide accurate, current, and complete information when creating your account.
- Maintain the security of your account credentials and not share your password with anyone.
- Notify us promptly at nestmindsupport@gmail.com if you suspect unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that we believe have been compromised, are used in violation of these Terms, or contain false or misleading information.
You may not create accounts on behalf of another person without their express authorization, and you may not sell, transfer, or assign your account to any third party.
4. Free and Pro Plans
Free Plan
New accounts begin on the Free Plan at no cost. The Free Plan includes:
- Up to 2 parent accounts on the Free Plan.
- Up to 30 tasks created per calendar month.
- Up to 10 events created per calendar month.
- Up to 1 user-created routine.
- Up to 3 user-created templates.
- Reports tab is visible, but weekly AI report generation is Pro-only.
NestMind Pro
NestMind Pro is a paid subscription that removes the above limits and unlocks additional features, including unlimited parent access, unlimited monthly tasks, unlimited monthly events, voice-command task creation, and weekly AI reports. Pro is available as a monthly or annual subscription purchased through Apple In-App Purchase.
By subscribing to NestMind Pro, you agree to the following:
- Billing: Your subscription will be charged to your Apple ID account at the price confirmed at the time of purchase. Pricing may vary by region and is displayed in the App prior to purchase.
- Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Free trial: Eligible new subscribers may receive a 7-day free trial on selected subscription plans.
- If not canceled at least 24 hours before the trial ends, the subscription automatically renews at the selected plan price.
- Free trial eligibility is determined by Apple and is generally available once per subscription group.
- Managing or cancelling: You can manage or cancel your subscription at any time through your Apple ID account settings (Settings › [Your Name] › Subscriptions on your iPhone). Cancellation takes effect at the end of the current billing period; you retain Pro access until that date.
- Refunds: All purchases are processed by Apple. We do not issue refunds directly. Refund requests must be submitted to Apple through their standard refund process. Apple's refund policies apply.
- Price changes: We may change subscription pricing with reasonable notice. Price changes take effect at your next renewal, and you will be notified in advance.
Downgrading from Pro to Free will not delete existing data. At the next billing cycle, Free Plan limits (parent, monthly task/event, routine/template, and Pro-only feature restrictions) will apply.
5. Acceptable Use
NestMind is designed for personal, household coordination use. You agree to use the App only for lawful purposes and in accordance with these Terms. You agree that you will not:
- Use the App for any commercial purpose or on behalf of any third party without our express written consent.
- Attempt to gain unauthorized access to any portion of the App, its servers, or any connected systems.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Transmit any content that is unlawful, harassing, threatening, abusive, defamatory, or otherwise objectionable.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Use the App in any manner that could interfere with, disrupt, or negatively affect the App or its servers.
- Attempt to circumvent subscription limits or access Pro features without a valid subscription.
- Use automated scripts, bots, or other tools to access or scrape the App.
- Use the App in any way that violates applicable local, national, or international laws or regulations.
Violation of these rules may result in immediate account suspension or termination, at our sole discretion.
6. Child Profiles and Parental Responsibility
NestMind allows adult users to add child profiles within a family group. Child profiles are intended for assigning age-appropriate household tasks and routines to minors who live in the same household. Children do not have their own login credentials and do not independently operate the App.
By adding a child profile to your family group, the adult account holder (parent or legal guardian) confirms that they:
- Have the authority to add the child's name and optional avatar to the App.
- Accept full responsibility for all use of the App in connection with the child's profile.
- Will supervise and control what tasks and content are assigned to the child's profile.
- Understand that all family members with access to the family group can view and interact with the child's profile.
We do not knowingly collect personal information directly from children under 13. All data associated with a child profile is entered by and attributed to the adult account holder. If you believe a child under 13 has independently created an account, please contact us at nestmindsupport@gmail.com and we will address it promptly.
7. Intellectual Property
The App, including its design, code, graphics, text, icons, and all other content created by us, is owned by NestMind App and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the App or its content.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal iOS device solely for your own personal, non-commercial household use, subject to these Terms and Apple's App Store terms of service.
Your content: You retain ownership of any content you create within the App (task descriptions, family names, routine details, etc.). By entering this content into the App, you grant us a limited license to store, process, and display it solely for the purpose of providing the App's functionality to you and your family group. We do not claim ownership of your content and do not use it for any purpose beyond operating the service.
The NestMind name and any associated logos are trademarks of NestMind App. You may not use these trademarks without our prior written permission.
8. Disclaimers and Limitation of Liability
Disclaimer of warranties
The App is provided on an "as is" and "as available" basis, without warranty of any kind. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of liability
To the fullest extent permitted by applicable law, NestMind App shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, or loss of goodwill — arising from or related to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
In no event shall our total aggregate liability to you for all claims arising from or related to the App exceed the greater of: (a) the total amount you paid us for the App in the twelve months preceding the claim, or (b) USD $10.
Some jurisdictions do not allow exclusion of certain warranties or limitation of certain types of damages. In such jurisdictions, the above exclusions and limitations apply only to the extent permitted by applicable law.
9. Termination
Termination by you: You may stop using the App and delete your account at any time from within the App (Settings › Account › Delete Account). If you have a Pro subscription, cancellation of your subscription must be done separately through your Apple ID settings. Deleting your account does not automatically cancel an active subscription.
Termination by us: We may suspend or terminate your access to the App, with or without notice, if we determine that you have violated these Terms, your account has been compromised, or we are required to do so by law. We will make reasonable efforts to notify you of the reason for termination where permitted.
Effect of termination: Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will continue in full force and effect.
If we discontinue the App entirely, we will provide at least 30 days' notice where reasonably possible.
10. Changes to Terms
We may update these Terms from time to time to reflect changes in the App, our practices, or applicable law. When we make changes, we will update the "Last updated" date at the top of this page.
For material changes — such as those that significantly affect your rights or obligations — we will provide notice via an in-app notification or email to the address associated with your account, at least 14 days before the changes take effect where practicable.
Your continued use of the App after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.
11. Governing Law
These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation in the first instance. If the parties cannot resolve a dispute through negotiation, the dispute shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction applicable to the developer's location.
If you are accessing the App from the European Union, you may also have rights under applicable EU consumer protection legislation that cannot be waived by contract. Nothing in these Terms limits rights that apply to you as a consumer under the laws of your country of residence.
These Terms do not limit any mandatory consumer rights you may have under the laws of the jurisdiction where you reside.
